Terms of Service

These terms are an agreement between you and Willow Glen Equity LLC, a California limited liability company doing business as ColorKind ("ColorKind," "we," "us" or "our"). They govern your use of the ColorKind iPhone app, website and coloring-page generation service. By using ColorKind, you agree to these terms. If you do not agree, do not use the service.

Parents and eligibility

ColorKind is offered to adults, parents and legal guardians. It is not intended for children to use independently. You are responsible for supervising a child’s use of printed pages and for choosing the ideas and photos submitted to the service.

The service

ColorKind uses artificial intelligence to create original coloring pages from a description or selected photo. Results can be inaccurate, unexpected, unrecognizable, incomplete or similar to existing works. We may modify, suspend or discontinue features, models or output formats.

Your content

You retain the rights you already have in ideas and photos you submit. You give ColorKind a limited license to process submitted content and privately store pages created from text to provide, secure, analyze, support and improve the service as described in the Privacy Policy. After review and de-identification, that license also permits ColorKind to use themes inspired by text prompts and text-generated pages in examples, collections, books and materials that explain or promote ColorKind. It does not permit marketing use of source photos or pages derived from photos. A page created from text may be reused to fulfill a later request with the same text and generation settings. You represent that you have permission to upload each photo and that your submission does not violate another person’s privacy, publicity, intellectual-property or other rights.

Generated pages

Subject to these terms and applicable law, you may use generated pages for personal, family, classroom and non-commercial activity use. ColorKind does not guarantee that an output is unique or eligible for copyright protection. Commercial resale, publication or brand use requires separate written permission.

Acceptable use

You may not use ColorKind to create or submit illegal, exploitative, sexual, hateful, violent, privacy-invasive or infringing material; attempt to identify or exploit a child; bypass safety or rate limits; probe or disrupt the service; automate excessive requests; or misrepresent AI output as an official branded or copyrighted work. Requests for protected characters or branded designs may be rejected or converted to an original generic theme.

Complimentary pages and subscriptions

New installations may receive complimentary coloring-page credits in an amount configured by ColorKind. Eligible unusable results may be regenerated without using another complimentary credit, subject to reasonable expiration, retry and abuse limits. A free retry is not a promise that the next result will be perfect.

ColorKind Unlimited is an auto-renewing subscription handled by Apple. Available durations, total prices and renewal terms are shown before purchase. Subscriptions renew unless canceled through your Apple Account at least 24 hours before the current billing period ends. Access continues through the paid period after cancellation.

“Unlimited” means normal, manual use by a family. Automated or programmatic generation, bulk commercial production, resale, account sharing outside Apple’s supported Family Sharing, attempts to burden the service and other abusive use are not included. ColorKind may temporarily slow or suspend abusive activity to protect service quality, security and availability, but does not impose a hidden monthly page allowance on ordinary family use.

Referrals and Guest Passes

Each eligible ColorKind signup may apply one referral code. A valid redemption can provide the referee and an eligible free referrer with seven calendar days of complimentary Unlimited. A referrer may earn multiple rewards, and valid rewards can extend the current complimentary expiration. A paid subscriber’s permanent referral link can continue to provide the referee’s reward, but it does not add or preserve future complimentary time for the paid subscriber.

Eligible direct paid subscribers may receive up to three separate 14-day Guest Pass slots during each rolling 90-day membership period. A Guest Pass is single use, expires when shown, does not roll over, requires Apple redemption and does not automatically renew. Family Sharing participants and people with complimentary Unlimited are not direct paid subscribers for Guest Pass eligibility.

Selected recipients may receive a one-year ColorKind Unlimited Offer Code fulfilled by Apple. This complimentary year is single use, ends on the date Apple displays after redemption, does not automatically renew and does not charge the recipient when it ends.

Referral and Guest Pass benefits have no cash value, cannot be sold or transferred after redemption and may not be obtained through self-referral, duplicate signups, automation, deception or other abuse. ColorKind may reject a redemption or revoke fraudulently obtained complimentary time. Ordinary households are not disqualified merely because people share a network.

Apple terms

If you download ColorKind through the App Store, Apple’s applicable usage rules and Standard End User License Agreement also apply. Apple is not responsible for providing ColorKind support. If these service terms conflict with mandatory Apple terms, the mandatory Apple terms control.

Intellectual property

The ColorKind name, branding, app, website, software, interface and service materials are owned by the ColorKind operator or its licensors. These terms do not grant permission to copy, reverse engineer, resell or create derivative services from them except where applicable law does not allow that restriction.

Disclaimers

To the maximum extent permitted by law, ColorKind is provided “as is” and “as available.” We do not promise uninterrupted availability, error-free output, fitness for a particular purpose or that every generated page will be safe or suitable without adult review. Parents and educators should review every page before giving it to a child.

Limitation of liability

To the maximum extent permitted by law, the ColorKind operator will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data or the cost of substitute services resulting from use of ColorKind. Nothing in these terms excludes rights or liability that cannot legally be excluded.

Termination and changes

We may restrict access when reasonably necessary to protect users, comply with law or address misuse. We may update these terms as the service changes. Material reductions to a paid subscription will apply prospectively, with appropriate notice and no earlier than the subscriber’s next renewal except where immediate action is reasonably necessary for security, legal compliance or abuse. The effective date above identifies the current version, and continued use after an update means you accept the revised terms where permitted by law.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute that is not subject to a separate valid arbitration agreement must be brought in a court with proper jurisdiction in California. This section does not limit consumer-protection rights that cannot be waived under the law where you live.
